Joseph A. Sammartino
After graduating from high school at The Bishop’s School in La Jolla, CA, Joe attended Georgetown University, where he earned a Bachelor of Arts in Government and Spanish. During his time in Washington, DC, Joe worked on Capitol Hill for three years. After graduating from college, Joe returned to San Diego and earned his Juris Doctor from the University of San Diego School of Law.
While in law school, Joe clerked for both the criminal division of the San Diego County City Attorney’s Office and the Appellate Division of the San Diego County District Attorney’s Office. By the end of law school, Joe had made dozens of court appearances and had won more than a dozen motions on behalf of the citizens of San Diego County. From this hands-on experience, he gained valuable insights into the criminal prosecutions and inner workings of the courts and legal system.
Immediately upon graduating from law school, Joe began working at a large, national AmLaw 100 firm. He represented an extensive and diverse client base, ranging from billion-dollar international companies to local San Diegans. Joe’s practice focused on protecting his clients’ rights and interests in a variety of contexts. He took and defended hundreds of depositions across the country, prepared and argued motions in trial and appellate courts, and engaged in numerous trials in state and federal courts throughout Southern California.
On the corporate and business side of his practice, Mr. Sammartino has helped form dozens of corporate entities, including S-corporations, C-corporations, LLCs, non-profits and mutual benefit corporations, as well as preparing and 501(c)(3) applications, shareholder purchase agreements, employment contract review, contract review and dispute resolution.
Mr. Sammartino also provides general business counseling and advising on a range of topics from employment, to financing and funding, dispute resolution and avoidance among other topics. One of the more frequent ways to he assists corporate clients is by serving as general counsel or as outside general counsel. The general counsel services provided by Mr. Sammartino have included:

In the litigation arena, Mr. Sammartino has litigated civil lawsuits on behalf of major international companies and has protected the rights of individuals in courts throughout the United States. His experience regarding product liability litigation includes defending Yamaha in what was, at the time, the largest wrongful death lawsuit ever arising out of a personal watercraft accident; the jury returned a defense verdict in less than one day.
In the employment law field, Mr. Sammartino defended a major multinational corporation in a wrongful termination and retaliation lawsuit.
In another major product-liability lawsuit that went to trial, Mr. Sammartino defended Coaster Company of America, the second-largest furniture importer in the U.S., in a product liability lawsuit; the case settled before the end of the trial.
Mr. Sammartino has also defended numerous small-cap and mid-cap businesses throughout the United States in product liability cases. Additionally, Mr. Sammartino has represented businesses and individuals in investor disputes, in trade secret misappropriation litigation, bad faith litigation, and employment litigation.
Earlier in his career, Mr. Sammartino represented many of the largest insurance companies in the United States and the world in bad faith lawsuits and in coverage disputes.
Mr. Sammartino handles all aspects of litigation from pre-litigation demands, negotiations, and settlements through the filing of complaints, discovery, comprehensive motion practice, depositions (serving as the lead attorney in over 300 depositions), mediation and settlement or trial and verdict in state and federal courts, including appellate practice.
